Antitrust law - enormous proceedings successfully concluded after 15 years
One of the most complex anti-trust fine proceedings in Germany with more than 130 days of proceedings ended on 02.10.2020. The liquefied gas cartel proceedings - also against one of our clients - made legal history, both because of the long duration and because of the significant increase in fines by the 4th Cartel Senate of the Düsseldorf Higher Regional Court compared to the fine notices of a total of 244 million euros for all persons and secondary parties affected. The main procedural phases were the fine proceedings (2005 to 2010), the appeal proceedings before the 4th Cartel Senate of the Düsseldorf Higher Regional Court (2010 to 2013), the appeal proceedings before the Federal Court of Justice (2013 to 2019 with referral back to the 6th Cartel Senate in Düsseldorf after annulment of findings and the fine amount statement), and the proceedings before the 6th Cartel Senate of the Düsseldorf Higher Regional Court from 2019 to the present day. For our client, the fine was reduced to one ninth of the amount imposed by the 4th cartel senate.
